By accessing or using SimplePhotoShare ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.
SimplePhotoShare is a platform for event photographers to upload, manage, and share photos with event guests. The Service includes a web-based dashboard, public gallery pages, a desktop uploader application, and AI photo enhancement features.
To use the Service, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized use.
The Service offers a Pay As You Go plan (no monthly fee) and monthly subscription plans. Event credits are required to create events. Each credit allows one event with unlimited photos.
Subscription fees are billed monthly through Stripe. Additional credits and AI wallet purchases are charged at the time of purchase. All fees are in US dollars unless otherwise stated.
You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of your current billing period. Unused event credits remain available until used. No refunds are provided for partial billing periods.
We may change our prices with 30 days' notice. Price changes will apply to the next billing cycle after the notice period.

You retain all ownership rights to the photos and content you upload. By uploading content, you grant us a limited license to store, process, display, and transmit that content as necessary to provide the Service (including AI processing when you enable it).
AI-styled photos created through the Service are derived from your original uploads. You own the AI-generated versions subject to the same rights as your originals.
When you create an event and share a gallery link, you authorize guests to view and download photos from that gallery. You are responsible for ensuring you have the right to share the photos you upload.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects availability. We will provide notice when possible for planned maintenance.
To the maximum extent permitted by law, SimplePhotoShare shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.
Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless SimplePhotoShare from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these terms.
We may suspend or terminate your account if you violate these terms. Upon termination, your right to use the Service ceases immediately. We will make your data available for export for a reasonable period following termination.
We may update these terms from time to time. Material changes will be communicated via email or a prominent notice on the Service. Continued use after changes constitutes acceptance of the new terms.
These terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the state in which SimplePhotoShare operates.
